The DEA's Administrative Law Judge has outlined the schedule and procedures for the upcoming cannabis rescheduling hearings, set to begin on January 21, 2025.
Hearing Schedule:
- Dates: January 21, 2025, through March 6, 2025
- Frequency: Every Tuesday, Wednesday, and Thursday
- Location: DEA Hearing Facility, Arlington, Virginia
Witness Testimony:
- Each designated participant is allotted 90 minutes to present their witness's testimony.
- Counsel may provide a two-minute opening statement about their witness and proposed exhibits.
- Cross-examination is limited to 20 minutes per opposing party and generally restricted to matters covered during direct examination.
Consolidation and Argument Options:
- Participants with similar objectives are encouraged to consolidate presentations.
- Consolidated parties may present up to two witnesses within a 120-minute timeframe.
- After a presentation, parties can choose between a ten-minute closing argument or submitting a brief (maximum 25 pages) within five business days.
Document Submission:
- All parties must serve each other with copies of their intended exhibits by January 3, 2025.
- Documents not timely supplied may be excluded from the hearing.
- The DEA is expected to present its witnesses on the first day of testimony.
